Please read these Terms of Service carefully before using ChatCup. By creating an account or using any part of our platform, you agree to be bound by these terms. If you do not agree, do not use ChatCup.
1. Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you (or the business you represent) and ChatCup ("we," "us," or "our") governing your access to and use of chatcup.ai and all related services. By accessing or using ChatCup in any way, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and accept these Terms in full.
If you are using ChatCup on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
ChatCup is an AI workforce platform that enables businesses to build, train, and deploy AI agents for customer-facing and internal workflows. The platform includes:
- AI agent builder for designing and configuring automated conversation agents
- Knowledge base management with document upload and processing
- Multi-channel deployment across Telegram, WhatsApp, Web Widget, Instagram, and Messenger
- Task pipelines for data collection, lead qualification, and document generation
- Team collaboration tools for managing agents and workspaces
- Analytics and conversation monitoring
A free tier is available with no credit card required. Paid plans unlock higher usage limits and additional features. We reserve the right to adjust plan features and limits with reasonable notice.
3. Account Registration
To use ChatCup you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account information up to date
- Maintain one account per person (duplicate accounts may be removed)
- Keep your login credentials confidential and not share them with others
- Notify us immediately at support@chatcup.ai if you suspect unauthorised access to your account
You are responsible for all activity that occurs under your account, whether or not you authorised it. ChatCup is not liable for any loss resulting from unauthorised use of your credentials.
4. Acceptable Use
You may use ChatCup only for lawful purposes and in accordance with these Terms. The following are prohibited:
- Using the platform to send spam, unsolicited bulk messages, or misleading communications
- Uploading or distributing illegal, harmful, defamatory, or infringing content
- Deploying AI agents to deceive, manipulate, or defraud end users
- Using agents to send content that is harassing, abusive, threatening, or discriminatory
- Attempting to reverse engineer, decompile, or extract the source code of any part of the ChatCup platform
- Circumventing rate limits, security controls, or access restrictions
- Reselling or sublicensing access to the platform without our written consent
- Using automated tools to scrape, crawl, or excessively query the platform
- Interfering with or disrupting the integrity or performance of the service
We reserve the right to investigate suspected violations and take action, including suspending or terminating accounts, without prior notice where necessary.
5. Your Content and Data
You retain ownership of all content, documents, and data you upload or create within ChatCup ("Your Content"). By using the platform, you grant ChatCup a limited, non-exclusive, worldwide licence to store, process, and use Your Content solely for the purpose of providing and improving the service to you.
When you upload documents to the knowledge base, they are processed through our document pipeline — which may include text extraction, chunking, and vectorisation — to enable AI agent responses. This processing is performed on your behalf as part of the service.
You represent and warrant that:
- You have all necessary rights, licences, and permissions to upload and use Your Content on the platform
- Your Content does not violate any applicable law or third-party rights
- You are solely responsible for the accuracy and legality of any data you collect through your AI agents
We do not sell Your Content to third parties. For details on how we handle personal data, please refer to our Privacy Policy.
6. AI-Generated Content
ChatCup's AI agents produce responses based on the knowledge base and configuration you provide. By nature, AI-generated content may be incomplete, inaccurate, or outdated. You acknowledge that:
- AI responses are not professional, legal, medical, financial, or expert advice of any kind
- You are responsible for reviewing and validating AI output before relying on it commercially or making it available to your customers
- ChatCup makes no warranty as to the accuracy, reliability, or fitness of AI-generated content for any particular purpose
- You are responsible for configuring your agents appropriately and ensuring their outputs comply with applicable laws and regulations in your industry
7. Intellectual Property
The ChatCup platform, including its software, design, branding, interfaces, and underlying technology, is owned by ChatCup and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights in the platform to you.
Your data is yours. We do not claim ownership of Your Content. You may export or delete your data at any time subject to the terms in the Termination section below.
If you provide feedback, suggestions, or ideas about the platform, you grant us the right to use that feedback without restriction or compensation.
8. Service Availability
We aim to provide a reliable, high-availability service. ChatCup infrastructure is built on Cloudflare's global network to maximise uptime and performance. However, we do not guarantee uninterrupted access to the platform.
The service may be temporarily unavailable due to:
- Scheduled maintenance (we will endeavour to provide advance notice where possible)
- Unplanned outages, infrastructure incidents, or third-party service failures
- Events beyond our reasonable control
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice for significant changes.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ChatCup and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid to ChatCup in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you.
10. Termination
You may delete your account at any time from your account settings. Upon account deletion, your data — including uploaded documents, agent configurations, and conversation history — will be permanently removed from our systems within a reasonable timeframe, except where retention is required by law.
We may suspend or terminate your access to ChatCup at any time, with or without notice, if we determine that you have violated these Terms, engaged in abusive or fraudulent behaviour, or pose a risk to other users or the platform. In cases of serious or repeated violations, termination may be immediate.
Upon termination, your right to use the service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.
11. Changes to Terms
We may update these Terms from time to time to reflect changes in the service, legal requirements, or our business practices. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or in-app notice.
Your continued use of ChatCup after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with a change, you should stop using the service and delete your account.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the competent courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
